What is Tri-Star Express?
In Brazil, the Express is an express (fast) mode of Import and Export of Cargoes, authorized by the Federal Customs Buerau to some specialized operators.
The Express allows for a much faster delivery process (maximum 6 hours after the aircraft arrives), so that the cargo can be delivered to the customer’s home, through a local logistics network. The tax amounts are fixed: 60% Import Tax + 18% State Tax (ICMS), making a total of approximately 96% of the CIF value of the Merchandise (Cost + Insurance + Freight). In Brazil, the Express applies to express import and export shipments.
How the process works
Commodity Release
After the flight arrives in Brazil, express cargo is directed to the Express Terminal, where it is processed, verified by local authorities. At this time, taxes are paid, and the cargo is already released to proceed to its final destination. The document regarding the cargo must be complete, with all the information required by the local authorities for the process to be automatic: Importer’s Name, Importer’s CPF or Importer’s CNPJ, Correct delivery address, Exact description of the goods, Exact value of the goods, Exact freight value. Your next action will depend on what the Federal Customs Agency (RFB) determined to mischaracterize your shipment as express cargo (express).
If the cargo has been uncharacterized but there is authorization for formal clearance, you must hire your own forwarder. It is necessary to be registered in the brazilian Radar system to release this load, in this case.
In some cases, there may be a shipping error from the Exporter who requested the Express to the carrier instead of using ordinary freight. Thus, there is the possibility of filing a request to de-characterize the express at the RFB and proceed with formal clearance.
If the goods are prohibited even for formal clearance, the solution is to return them to the Exporter. We warn you that abandoning the cargo for forfeiture is risky, as storage and destruction costs may be charged.
If goods are retained, the customer must urgently settle.
The deadline stipulated by the RFB for returning the goods is 30 days, counting at the time of registration of the DIR (Declaration of Importation of Shipping). If the customer is having problems with the return, he can request more time, but in general, after this time, the cargo goes to forfeit.
